L’opposant et député, inculpé entre autres pour outrage au chef de l’État, n’est pas sorti de sa cellule en dépit de l’arrêt de la Cour de cassation ordonnant son assignation à résidence surveillée avant le début de son procès. Ses partisans sont irrités et dénoncent la mauvaise foi du parquet général censé exécuter cette décision judiciaire.

Les responsables de la prison centrale de Makala où l’ancien chef du parti présidentiel est détenu depuis le 12 août, confirment avoir reçu notification de l’arrêt rendu en faveur de Jean-Marc Kabund, depuis huit jours. Mais c’est au parquet général qu’il revient désormais de venir chercher le député, de désigner le lieu de son assignation et réquisitionner les policiers de garde.

De bonne source, le parquet général pourrait assigner l’ancien lieutenant du régime dans une résidence autre que sa villa de Kingabwa, située au cœur d’un quartier populaire. Ses avocats protestent. « La détention arbitraire du président Jean-Marc Kabund devient plus qu’un cas emblématique du déni de justice en République démocratique du Congo. Face aux gesticulations du pouvoir judiciaire, nous lançons donc un appel urgent au parquet général près la Cour de cassation de se libérer de toute dérive dictatoriale. Nous décourageons toute tentative tendant à mettre l’honorable Jean-Marc Kabund à un endroit non sécurisé car il en va de son intégrité physique. La résidence de Jean-Marc Kabund est bien connue », a déclaré Maître Emmanuelli Kahaya, son directeur de cabinet.

En réaction, le nouveau parti de Jean-Marc Kabund, l’Alliance pour le changement, annonce vouloir saisir les instances internationales. Quant à la procédure en RDC, le parquet général et la défense attendent que la Cour leur communique une date pour le début du procès. Un procès que les proches de l’accusé souhaitent public et médiatisé.
