Du jamais vu en III ème République, un ministre de Justice en exercice, jugé par la justice en France. Le monsieur s’appelle Eric Dupond-Moretti, garde des sceaux de la France. A partire d’aujoirdhui, il sera pendant dix jours sur le banc des accusés dans un tribunal.
A partir d’aujourdhui lundi 06 novembre 2023 ,le garde des sceaux en exercice est assis et c’est pendant dix jours sur le banc des accusés du tribunal de la CJR (Cour de justice de la République (CJR)). Cette juridiction est la seule en France habilitée à poursuivre et juger des membres du gouvernement en exercice pour des faits commis dans l’exercice de leur fonctions. Le monsieur encourt jusqu’à cinq ans d’emprisonnement et 500.000 euros d’amende pour prise illégale d’intérêts, ainsi qu’une peine d’inéligibilité et d’interdiction d’exercer une fonction publique.

De quoi est-il accusé?
Eric Dupond-Moretti est accusé d’avoir abusé de ses fonctions de ministre pour régler des comptes liés à son passé d’avocat. M. Dupond-Moretti lui reste “serein” car il se dit « innocent » qui n’a fait que suivre «les recommandations » de son ministère quand il lançant des enquêtes administratives contre quatre magistrats avec qui on dit qu’il a eu des différends quand il était avocat.Il dit qu’il est « Impatient » de « s’expliquer » devant la CJR.
Un procès, deux dossiers
Le journal Ouest France.fr rapporte que l’association Anticor (anticorruption) et les deux principaux syndicats de magistrats ont porté plainte fin 2020, dénonçant une situation de conflits d’intérêts du ministre dans deux dossiers. Le premier concerne l’enquête administrative ordonnée contre trois magistrats du Parquet national financier (PNF).
Ces derniers ont fait éplucher des factures téléphoniques de pénalistes, dont Éric Dupond-Moretti, pour débusquer une éventuelle taupe qui aurait informé Nicolas Sarkozy qu’il était sur écoute dans l’affaire de corruption dite « Paul Bismuth ». L’ex-ténor du barreau fustige des « méthodes de barbouzes » en découvrant ces investigations, en juin 2020. Et porte plainte.
La ministre de la Justice d’alors, Nicole Belloubet, demande une « inspection de fonctionnement » sur cette enquête du PNF. Inspection qu’Éric Dupond-Moretti, qui lui succède peu après, refuse de suspendre malgré des alertes sur le risque de conflit d’intérêts. À la réception du rapport, il décide de lancer l’enquête administrative pour déterminer s’il y a eu des fautes individuelles des magistrats.
Puis vient le second dossier où le garde des Sceaux est accusé d’avoir diligenté des poursuites administratives contre un ex-juge d’instruction détaché à Monaco, Édouard Levrault. L’avocat Dupond-Moretti avait auparavant pointé ses méthodes de « cow-boy ». Et porté plainte contre lui au nom d’un client pour violation du secret de l’instruction.
