Donald Trump doit “comparaître pour sa sentence, à la suite de sa condamnation, le 10 janvier 2025”, a ordonné le juge Juan Merchan dans une ordonnance de vendredi, tout en précisant ne pas être “enclin à imposer une peine d’incarcération” à l’homme qui deviendra le 20 janvier le 47e président des États-Unis.
Le président républicain devra se présenter en personne au tribunal, dans le sud de la grande île new-yorkaise de Manhattan, ou à distance par vidéo, mais il devra faire connaître sa “préférence” d’ici dimanche, selon le magistrat.
Le juge a écrit dans son ordonnance de 18 pages qu’il lui “semblait adéquat de faire savoir que le tribunal ne serait pas enclin à imposer une peine d’incarcération”, même si une telle “sentence est encourue dans la condamnation”.

Le premier président américain condamné au pénal
Le 30 mai, Donald Trump, 45e président américain, avait été le premier ancien locataire de la Maison Blanche à être pénalement condamné dans l’histoire du pays.
Le jury du tribunal de Manhattan, dépendant de la justice locale de l’État de New York, l’avait reconnu coupable de 34 chefs d’accusation pour des paiements cachés à une star du porno, Stormy Daniels, effectués juste avant la présidentielle de 2016, qu’il avait remportée.
Selon la justice, le milliardaire souhaitait que cette femme, Stephanie Clifford de son vrai nom, taise un bref rapport sexuel en 2006 alors que Donald Trump était marié à Melania. L’intéressé nie toute relation sexuelle avec la star du X.
Après des mois de recours et l’élection remportée le 5 novembre, le camp Trump n’a pas réussi à faire annuler ce verdict historique sur la base de l’immunité présidentielle qui a été élargie le 1er juillet par une décision de la Cour suprême des États-Unis.
Sous une énorme pression politique, le juge Merchan avait plusieurs fois repoussé depuis le 30 mai le prononcé de la peine, a fortiori depuis la victoire à la présidentielle.
Une “attaque politique illégitime”
Dans la soirée, Donald Trump a tonné sur son réseau Truth Social contre une “attaque politique illégitime qui n’est rien d’autre qu’une mascarade” et s’en est pris une nouvelle fois au juge Merchan, “partisan extrémiste” et “sans respect pour la Constitution”.

La volonté de ce magistrat d’aller au bout de la procédure pénale “est une atteinte directe à la décision de la Cour suprême concernant l’immunité”, avait écrit plus tôt dans un communiqué le porte-parole de Donald Trump, Steven Cheung. Il a dénoncé “les chasses aux sorcières” orchestrées selon lui par l’administration sortante de Joe Biden.
