Les droits voisins ouvrent la voie à une rémunération pour les auteurs des contenus présentés sur les pages de résultats des grandes plateformes du Net.
Le géant Facebook a conclu un accord avec une partie de la presse quotidienne française pour rémunérer celle-ci au titre des “droits voisins”, a annoncé, jeudi 21 octobre, le réseau social américain, quelques semaines après avoir signé des accords de même type avec Le Monde et Le Figaro.
Cet “accord de licence” signé avec l’Alliance pour la presse d’information générale (Apig), qui représente notamment les quotidiens nationaux et régionaux, “prévoit que Facebook obtienne et rémunère des licences pour les droits voisins”, selon le communiqué.
“Par ailleurs, il donnera la possibilité aux éditeurs de l’Alliance qui le souhaitent de participer à Facebook News”, un nouveau service dédié à l’information qui doit être lancé en France en janvier 2022, a précisé le réseau social.
“Les termes auxquels nous sommes parvenus permettront à Facebook d’appliquer la directive et la loi française, tout en générant des financements importants pour les éditeurs de l’Alliance, notamment les plus petits d’entre eux”, s’est félicité Pierre Louette, président de l’Apig et PDG du Groupe Les Échos – Le Parisien, cité dans le communiqué.
Ni le montant de la rémunération ni la méthode de calcul n’ont été divulgués.
Rémunération pour les auteurs
Les droits voisins sont explicitement prévus par une nouvelle législation européenne adoptée en 2019, immédiatement transposée en France.
Ils ouvrent la voie à une rémunération pour les auteurs des contenus de presse, extraits d’articles, photos, vidéos, infographies… présentés sur les pages de résultats des grandes plateformes du Net.
Mais celles-ci ont longtemps contesté leur principe, et les négociations avec la presse ont été très laborieuses.
Un accord-cadre concernant la rémunération des “droits voisins” avait été annoncé en janvier entre l’Apig et Google, mais il doit être revu pour tenir compte d’une condamnation en juillet du moteur de recherche par l’Autorité de la concurrence à une amende de 500 millions d’euros pour ne pas avoir négocié “de bonne foi” avec les éditeurs de presse.
L’Autorité a demandé au géant américain de reprendre les négociations avec les éditeurs, pour leur proposer une nouvelle offre de rémunération.
Les groupes Le Monde et Le Figaro ont annoncé tous deux il y a moins d’un mois des accords distincts avec Facebook, comme ils l’avaient fait auparavant avec Google, au titre de la rémunération et de la mise en avant de leurs contenus.
