Le Front patriotique rwandais (FPR) a continué d’étouffer les voix dissidentes et critiques et de cibler les personnes perçues comme constituant une menace pour le gouvernement, ainsi que les membres de leurs familles. L’espace réservé à l’opposition politique, à la société civile et aux médias est resté fermé.
Plusieurs détracteurs très en vue, dont des membres de l’opposition et des commentateurs qui s’exprimaient sur les réseaux sociaux ou sur YouTube, ont disparu ou été victimes d’arrestations ou de menaces. Les détentions arbitraires, les mauvais traitements et les actes de torture perpétrés dans des centres de détention aussi bien officiels que non officiels ont été monnaie courante, et les normes de procès équitable ont été régulièrement bafouées dans des affaires jugées sensibles. Des informations crédibles ont été signalées concernant des détentions arbitraires et des mauvais traitements de personnes accusées de présenter des « comportements déviants », y compris des enfants des rues, des travailleurs sexuels et des petits commerçants.
Répression politique
L’espace politique et civique au Rwanda est resté clos. En mars, Christopher Kayumba, l’ancien rédacteur en chef du journal The Chronicles, a créé un nouveau parti politique, la Plateforme rwandaise pour la démocratie (Rwandese Platform for Democracy, RDP). Cela faisait suite à la publication d’une lettre ouverte dans laquelle Kayumba critiquait la manière dont le Président Paul Kagame gérait la crise du Covid-19 et son impact sur la population, et dénonçait l’existence de « maisons privées » où des personnes étaient régulièrement détenues illégalement et torturées.
Peu après, des allégations de viol et de « comportement sexuel répréhensible » ont été portées contre lui et il a été arrêté en septembre. Il a débuté une grève de la faim quelques jours après son arrestation afin de protester contre ces charges « politiquement motivées » et a dû être transféré vers un hôpital pour y être soigné. Il a été transféré vers la prison de Nyarugenge à Kigali après que sa demande de mise en liberté provisoire avait été refusée en octobre.
D’autres personnalités de l’opposition politique, notamment Victoire Ingabire, ont continué de faire face à des mesures d’obstruction dans leur travail, y compris à des menaces et des actes de harcèlement émanant des autorités. Les autorités ont détenu dix personnes autour du « Ingabire Day », événement prévu pour le 14 octobre et organisé par Dalfa-Umurinzi, parti de l’opposition non enregistré, afin de débattre, entre autres, de la répression politique au Rwanda. Au moment de la rédaction de ce chapitre, sept membres du parti et un blogueur sur YouTube ont été inculpés de plusieurs crimes comprenant la « propagation de rumeurs » et la « propagation de fausses informations dans le but de créer une opinion internationale hostile à l’État rwandais » et d’« inciter au soulèvement ou aux troubles au sein de la population ».
En septembre, Paul Rusesabagina, détracteur et opposant politique, a été condamné à une peine de 25 ans de prison pour des charges comprenant le meurtre et l’appartenance à un groupe terroriste après un procès entaché d’irrégularités représentatif de l’ingérence du gouvernement et de sa manipulation du système judiciaire. Rusesabagina a été victime d’une disparition forcée avant d’être renvoyée au Rwanda de manière illégale en août 2020. Son procès a été caractérisé par des violations de la procédure régulière et du droit à un procès équitable.
Liberté d’expression
YouTube a continué d’être un espace contesté pour la liberté d’expression au Rwanda. Depuis quelques années, frustrés par l’absence de débat critique dans les médias, des blogueurs et commentateurs rwandais se servent de cette plateforme pour publier des vidéos sur des sujets sensibles et débattre de thèmes d’actualité. Parmi ces thèmes figurent les expulsions des habitants des quartiers pauvres de Kigali, la capitale, les confinements stricts imposés en réponse au Covid-19, ou les commémorations du génocide de 1994.
Le 9 février, Innocent Bahati, chanteur et poète de 31 ans, a été porté disparu auprès du Bureau d’enquêtes rwandais (Rwanda Investigation Bureau, RIB) deux jours après avoir été aperçu à Nyanza, dans la province du Sud. Ses poèmes, qu’il déclamait dans des vidéos publiées sur YouTube, portaient essentiellement sur des thèmes sociaux comme la pauvreté croissante ou la critique du confinement et son impact. Bien que le porte-parole du RIB ait déclaré aux médias qu’une enquête était en cours pour le retrouver, les résultats n’ont jamais été publiés et l’on ignore toujours où se trouve Bahati.
Des commentateurs en ligne tels qu’Yvonne Idamange et Aimable Karasira se sont également servis de leurs vidéos pour parler du génocide de 1994, des crimes commis par le RPF au pouvoir au lendemain du génocide, ou des commémorations du génocide organisées par le gouvernement.
Le 30 septembre, Yvonne Idamange, survivante du génocide contre les Tutsis, qui avait accusé le gouvernement de tirer des bénéfices financiers du génocide et lancé un appel à la protestation, a été déclarée coupable d’incitation à la violence et à l’insurrection, de dénigrement des mémoriaux du génocide et de propagation de rumeurs et d’attaques violentes, entre autres charges. Son procès s’est tenu à huis clos et elle a écopé d’une peine de 15 ans de prison.
Le 31 mai, Aimable Karasira a été arrêté pour avoir nié et justifié le génocide et avoir semé la division parmi les Rwandais. Pendant plusieurs mois, il a été harcelé en permanence et convoqué par les autorités rwandaises pour avoir publié des vidéos critiques sur YouTube dans lesquelles il évoquait l’histoire de sa famille et le génocide. Il a parlé ouvertement des meurtres perpétrés par les soldats du RPF au lendemain du génocide.
Dieudonné Niyonsenga, également connu sous le pseudonyme « Cyuma Hassan », propriétaire d’Ishema TV, et son chauffeur, Fidèle Komezusenge, ont été arrêtés en avril 2020 après qu’il avait rendu compte de l’impact des directives prises en réponse au Covid-19 sur les populations vulnérables. Ils ont été accusés d’usage de faux, d’usurpation d’identité de journaliste et d’obstruction auprès d’agents des forces de l’ordre. Les deux hommes ont été acquittés le 12 mars 2021 après près d’une année en détention. L’accusation a fait appel du verdict, et Niyonsenga a été de nouveau arrêté le 11 novembre, la Haute cour de Kigali étant revenue sur son acquittement.
Après sa libération en mars, Niyonsenga avait expliqué dans des interviews sur YouTube que les autorités l’avaient détenu dans plusieurs lieux inconnus, où il avait été menacé et où on lui avait ordonné d’avouer qu’il collaborait avec un parti d’opposition en exil qui entretiendrait des liens avec des groupes armés.
Des blogueurs et d’autres commentateurs de YouTube ont déclaré avoir été menacés et avoir reçu des pots-de-vin pour diffuser des informations favorables à la ligne du gouvernement.
Répression au-delà des frontières
Le gouvernement rwandais et des individus œuvrant pour son compte ont continué de faire pression sur les communautés réfugiées et la diaspora rwandaises, jusqu’en Australie et au Canada. Des réfugiés connus pour être des détracteurs du gouvernement ont été menacés et harcelés. En Afrique, Human Rights Watch a documenté et reçu des rapports crédibles selon lesquels des réfugiés et des demandeurs d’asile rwandais étaient victimes de disparitions forcées et obligés de rentrer au Rwanda, ou tués.
Cassien Ntamuhanga, demandeur d’asile rwandais au Mozambique et fondateur d’un mouvement d’opposition, a été placé en détention par la police mozambicaine le 23 mai, en présence d’une personne suspectée de parler le kinyarwanda. Il n’a pas été vu depuis. Ntamuhanga a été condamné au Rwanda à l’issue d’un procès fortement politisé, en même temps que le chanteur et activiste Kizito Mihigo, en février 2015. L’intervention militaire rwandaise dans la région dévastée de Cabo Delgado au Mozambique, annoncée en juillet, a soulevé des préoccupations quant à la sécurité des réfugiés et des demandeurs d’asile rwandais. Révocat Karemangingo, ancien officier de l’armée rwandaise, a été tué par balle à Maputo en septembre. Les circonstances de sa mort sont floues. D’autres Rwandais ont signalé avoir fait l’objet de menaces au Mozambique.
En juillet, Amnesty International et Forbidden Stories ont signalé que plus de 3 500 activistes, journalistes et politiciens — aussi bien au Rwanda qu’à l’étranger — avaient été des cibles potentielles du logiciel espion Pegasus, du Groupe NSO, employé par les autorités rwandaises. D’après l’analyse criminalistique numérique de son téléphone, le logiciel espion avait servi à infecter le téléphone de Carine Kanimba, la fille de Rusesabagina, qui vit en Belgique. La liste obtenue par les groupes aurait aussi inclus le nom et le numéro de téléphone de Ntamuhanga, même si l’on ignore précisément si son téléphone a été infecté.
Orientation sexuelle et identité de genre
Le Rwanda est l’un des rares pays d’Afrique de l’Est à ne pas ériger en infraction les relations consensuelles entre personnes de même sexe, et les politiques gouvernementales en la matière sont généralement considérées comme étant progressistes. Cependant, en pratique, des personnes lesbiennes, gays, bisexuelles et transgenres (LGBT) signalent avoir été stigmatisées. En 2021, Human Rights Watch a rendu compte de la manière dont les autorités avaient détenu arbitrairement neuf personnes transgenres ou gays au centre de transit de Gikondo, à Kigali.

Covid-19
D’après la Banque mondiale, l’économie rwandaise était parmi celles qui étaient le plus affectées par la pandémie en Afrique subsaharienne, le gouvernement n’ayant pas protégé le droit à bénéficier d’un niveau de vie adéquat au moyen d’une protection sociale renforcée, après avoir imposé des mesures de confinement rigoureuses qui ont « dramatiquement accru la pauvreté ». Cela a particulièrement affecté les personnes vivant en zone urbaine, les enfants et les femmes. La police a détenu de façon arbitraire dans des stades des dizaines de milliers de personnes accusées d’avoir enfreint les mesures de santé publique, sans motifs juridiques ni procès équitable. Le gouvernement perçoit toute critique de sa réponse comme particulièrement sensible. Plusieurs personnes qui ont critiqué publiquement la riposte du gouvernement à la pandémie et parlé ouvertement sur son impact sur les populations rwandaises les plus démunies ont été arrêtées et poursuivies en justice.
Tout au long de l’année 2021, les autorités ont continué d’utiliser le centre de transit de Gikondo, où des personnes pauvres et marginalisées sont détenues de manière arbitraire et battues régulièrement, souvent dans des conditions de surpeuplement. Cependant, les autorités n’ont pas mis en œuvre de mesures pour protéger les détenus du Covid-19.
Les fermetures d’écoles en raison de la pandémie de Covid-19 ont affecté 3,5 millions d’enfants. Après le début de la pandémie en 2020, les écoles ont été fermées ou partiellement fermées pendant 360 jours, y compris pendant plusieurs semaines en janvier et février 2021.
Justice internationale
Vingt-sept années après le génocide de 1994, un nombre considérable de personnes responsables du génocide, dont d’anciens hauts fonctionnaires et d’autres personnalités clés, ont été traduites en justice.
Le 25 septembre, des agents maliens ont annoncé la mort de Théoneste Bagosora, ancien colonel de l’armée rwandaise, condamné pour avoir orchestré des meurtres perpétrés lors du génocide de 1994. Bagosora, âgé de 80 ans, purgeait une peine de 35 ans de prison après avoir été reconnu coupable de crimes contre l’humanité par l’ex-Tribunal pénal international pour le Rwanda (TPIR).
Ces dernières années, le gouvernement rwandais a demandé ou signé des traités d’extradition avec des dizaines de pays dans l’espoir que les dernières personnes suspectées d’avoir participé au génocide soient renvoyées au Rwanda pour y être jugées, malgré la persistance de préoccupations quant au respect des normes de procès équitable lors des procès sur les atrocités commises sur le territoire national. En juillet, Venant Rutunga, 72 ans, a été extradé depuis les Pays-Bas vers le Rwanda pour y être jugé pour trois chefs d’accusation, notamment son rôle dans le génocide, sa complicité dans les meurtres et les crimes contre l’humanité, d’après l’Organe national de poursuite judiciaire.
En avril, Beatrice Munyenyezi a été déportée par les États-Unis après avoir purgé une peine de prison pour avoir menti sur sa demande de naturalisation. Elle a été arrêtée à son arrivée au Rwanda. Elle fait face à sept chefs d’accusation liés au génocide de 1994, y compris complicité de viol.
Principaux acteurs internationaux
La réunion des chefs d’États du Commonwealth, qui devait se tenir à Kigali en juin 2020 et avait été reportée à juin 2021, a été de nouveau remise à plus tard du fait de la pandémie. Des personnes démunies et marginalisées étaient détenues au centre de transit de Gikondo à l’approche de l’événement prévu pour le mois de juin 2021 ; des détenus ont déclaré que la police leur avait dit qu’ils ne voulaient pas d’eux dans les rues pendant la réunion.
En mars, après des décennies de relations tendues entre la France et le Rwanda, une commission instaurée par le Président Emmanuel Macron pour enquêter sur le rôle de la France dans les meurtres perpétrés en 1994 a publié un rapport de 1 200 pages qui concluait que la France avait des responsabilités qu’elle qualifiait de « lourdes et accablantes », y compris pour avoir fait preuve d’aveuglement devant le déclenchement du génocide et avoir tardé à rompre avec le gouvernement qui l’orchestrait. Un rapport commandité par le gouvernement rwandais concluait en avril que le gouvernement français « porte une lourde responsabilité pour avoir rendu possible un génocide prévisible ».
En février et octobre, le Parlement européen a adopté deux résolutions condamnant la disparition forcée et le procès inéquitable de Rusesabagina, ainsi que, d’une manière plus générale, le bilan du Rwanda en matière de droits humains. Cependant, d’autres institutions de l’Union européenne restent réticentes à faire part publiquement de leurs préoccupations quant aux atteintes aux droits humains perpétrées par les autorités du Rwanda.
