La candidate à l’élection présidentielle et ancienne ministre de la Justice Christiane Taubira a annoncé devant ses soutiens réunis samedi 12 février à Créteil, en région parisienne, qu’elle voulait mettre en place une “cour d’équité territoriale” si jamais elle remporte le scrutin du 24 avril prochain.
Je vais créer une cour d’équité territoriale, qui devra vérifier que les services publics correspondent bien partout sur le territoire, ici et dans les Outre-mer.

L’ex-députée de Guyane, qui a remportée la Primaire populaire au mois de janvier, souhaite qu’une instance judiciaire puisse contrôler l’accès qu’a la population aux services publics sur tout le territoire français, y compris dans les Outre-mer. Ces derniers sont souvent sujets aux problèmes d’accès à l’eau potable, par exemple.
Une idée de Jean-Louis Borloo
Cette proposition n’est cependant pas nouvelle. Elle était apparue dans le rapport remis au gouvernement par Jean-Louis Borloo, en 2018, qui avait été chargé par Emmanuel Macron de réfléchir à un plan pour améliorer la vie dans les banlieues françaises. L’ancien ministre de la Ville (2002-2004), qui voulait que les acteurs publics soient juridiquement contraints de tout mettre en œuvre pour permettre l’égal accès de la population aux services publics, suggérait alors la création d’une “cour d’équité territoriale”, “chargée de vérifier la mise en œuvre des moyens de rééquilibrage des politiques publiques sur les territoires carencés“.
Le plan Borloo, dont les mesures n’ont pas été reprises par le gouvernement, prévoyait que :
[La cours d’équité territoriale” puisse] condamner tout gestionnaire public ayant failli à l’obligation de moyens qui s’impose à lui pour contribuer à l’équité territoriale des citoyens au regard du service public, ou fait obstruction à sa mise en œuvre.
