Avec la peinture rose de ses murs qui s’estompe, l’hôtel Rouge par Désir se trouve à environ 10 minutes de route du centre de Kigali, la capitale du Rwanda.
Cet hôtel de six étages dispose de 72 chambres avec vue sur la ville vallonnée.
Il est situé dans une zone résidentielle composée de maisons individuelles et d’entreprises, et sera l’un des endroits de la ville où le Rwanda prévoit d’accueillir les demandeurs d’asile envoyés par le Royaume-Uni dans le cadre d’un accord controversé entre les deux gouvernements.
Le directeur des opérations, Jackie Uwamungu, me fait joyeusement visiter les lieux.
“Nous avons des chambres VIP, argent, doubles et jumelles, une piscine et une salle de conférence”, dit-elle alors que nous montons les escaliers.
Les chambres sont basiques, avec un lit, une armoire mobile, un bureau et des chaises, et une petite télévision fixée au mur.
L’hôtel prend encore des réservations, mais nous remarquons qu’il y a très peu de clients.
Les affaires se remettent à peine des longues perturbations causées par la pandémie de Covid-19, explique Mme Uwamungu.
L’accord migratoire est donc un soulagement bienvenu.
“Oh, cela va booster notre activité, honnêtement”, admet-elle.
Mais tous les Rwandais ne sont pas enthousiastes à l’idée de cet accord.
Victoire Ingabire Umuhoza, politicienne de l’opposition et ancienne prisonnière politique, estime qu’avant d’offrir d’accueillir des demandeurs d’asile, le gouvernement rwandais devrait s’attacher à résoudre les problèmes politiques et sociaux qui poussent les Rwandais à chercher refuge à l’étranger.
Le gouvernement rwandais a la réputation d’être répressif dans les milieux des droits de l’homme. Il a déjà été accusé d’envoyer des escadrons de tueurs à gages pour tuer les dissidents en exil et d’exiger la loyauté des Rwandais de la diaspora.
Le Premier ministre britannique Boris Johnson a défendu le projet de son gouvernement d’envoyer des demandeurs d’asile dans ce pays d’Afrique de l’Est.
“Le Rwanda s’est totalement transformé au cours des dernières décennies, c’est un pays très, très différent de ce qu’il était”, déclarait-il récemment, bien que la plupart des critiques visent le gouvernement du président Paul Kagame, au pouvoir depuis 1994.
Bien que l’on ne sache pas exactement combien de demandeurs d’asile le Royaume-Uni prévoit d’envoyer, le Rwanda a également identifié 102 chambres à la résidence Hallmark dans la banlieue de Nyarugunga à Kigali.
Il y a 30 bungalows meublés de trois et quatre chambres à coucher, avec leurs propres portes et jardins.
La directrice générale Nina Gatesi admet qu’elle ne sait pas grand-chose de l’accord avec les migrants et que l’établissement n’a pas encore signé d’accord avec le gouvernement rwandais. Mais elle affirme que la résidence est désireuse de fournir un hébergement.
Les autres migrants seront hébergés au Hope Hostel, plus rudimentaire, actuellement en cours de rénovation.
L”accord de partenariat en matière d’asile” signé par les gouvernements britannique et rwandais stipule que l’accord durera cinq ans à compter du jour de son entrée en vigueur et pourra être renouvelé au cours de la quatrième année – bien que les groupes de défense des droits aient promis d’organiser une action en justice contre cet accord au Royaume-Uni afin de contrecarrer sa mise en œuvre.
A la question de savoir ce que cela représente pour le Rwanda, la porte-parole du gouvernement, Yolande Makolo, répond : “Eh bien, ce que cela représente pour nous tous qui sommes signataires de la Convention sur les réfugiés ? Nous nous sommes engagés à protéger les personnes qui fuient les persécutions et nous l’avons fait dans notre histoire récente, au cours des presque 30 dernières années maintenant.”
Le gouvernement britannique affirme qu’il “investira 120 millions de livres (plus de 93 milliards) dans le développement et la croissance économiques du Rwanda” et financera “les opérations d’asile, l’hébergement et l’intégration de manière similaire aux coûts encourus au Royaume-Uni pour ces services”.
L’accord est décrit par les deux gouvernements comme un “partenariat de migration et de développement économique”.
Il s’agit peut-être d’une victoire en termes de relations publiques pour le pays d’Afrique de l’Est, mais de sérieuses préoccupations continuent d’être soulevées quant à son bilan en matière de droits de l’homme.
Le groupe de campagne Human Rights Watch a accusé le gouvernement britannique de “négliger les abus” pour justifier une politique d’asile “cruelle”.
Son directeur pour l’Afrique centrale, Lewis Mudge, a critiqué l’évaluation de la sécurité du Rwanda réalisée par le Royaume-Uni, estimant qu’elle “sélectionnait les faits, ou les ignorait complètement, pour étayer une conclusion évidente”.
M. Mudge a déclaré que les autorités rwandaises ont fait un usage excessif de la force lors de manifestations concernant les rations alimentaires des réfugiés de la République démocratique du Congo voisine en février et mars 2018, tuant 12 personnes et en arrêtant 60.
Il a également indiqué qu’au moins 35 réfugiés avaient été condamnés à des peines allant de trois mois à 15 ans de prison entre octobre 2018 et septembre 2019.
Dans un cas, ajoute M. Mudge, un réfugié a été accusé de partager des informations avec Human Rights Watch et purge actuellement une peine de 15 ans.
Le gouvernement rwandais conteste ces allégations et accuse Human Rights Watch d’avoir des antécédents de publication de fausses allégations et d’affabulations.
Mme Makolo affirme que le Rwanda “se porte aussi bien que n’importe quel autre pays” en matière de droits de l’homme.
Il s’agit d’un “travail en cours, même au Royaume-Uni lui-même [et dans les] pays les plus avancés”, dit-elle, ajoutant que les réfugiés qui s’identifient comme LGBTQ seraient “aussi libres que n’importe qui d’autre” au Rwanda.
Dans son conseil aux voyageurs pour le Rwanda, le gouvernement britannique indique que l’homosexualité n’est pas illégale dans le pays mais “reste mal vue par beaucoup”.
“Les personnes LGBT peuvent être victimes de discrimination et d’abus, y compris de la part des autorités locales. Il n’existe pas de lois spécifiques contre la discrimination qui protègent les personnes LGBT”, ajoute-t-il.
À la question de savoir si la conclusion de l’accord permet au gouvernement britannique d’abdiquer sa responsabilité envers les réfugiés en vertu du droit international, Mme Makolo répond que la Convention sur les réfugiés ne dit pas “qu’ils ont le droit absolu de choisir le pays où ils vont”.
“Nous considérons donc qu’il s’agit d’une responsabilité commune. Le Rwanda veut faire partie de la solution”, ajoute-t-elle.
Le Rwanda traitera les demandes d’asile des migrants et “les installera ou les renverra” conformément à la loi rwandaise, à la Convention sur les réfugiés et aux lois internationales, selon l’accord.
Le Danemark est également en pourparlers avec le Rwanda pour conclure un accord similaire.
Un autre accord concernant les migrants, dans le cadre duquel des centaines de demandeurs d’asile ont été transférés de Libye au Rwanda, est géré par le HCR, l’agence des Nations unies pour les réfugiés.
Ils sont hébergés à Gashora, un camp situé à environ 60 km au sud de la capitale.
Près de 1 000 personnes, pour la plupart originaires de la Corne de l’Afrique, y ont été déplacées depuis 2019.
Selon les responsables, 626 personnes ont été réinstallées dans des pays tiers, principalement au Canada, en Suède, en Norvège, en France et en Belgique.
Au moins cinq réfugiés du camp auquel j’ai parlé ont ri lorsqu’on leur a demandé s’ils voulaient s’installer dans un pays africain, notamment au Rwanda.
Beaucoup ont enduré la torture, la famine, l’extorsion par des trafiquants d’êtres humains, l’esclavage et ont survécu à des conditions désertiques difficiles ou à des tentatives de traversée de la Méditerranée.
S’ils ont tous déclaré que le Rwanda était un endroit plus sûr et plus accueillant, leur détermination à vivre un jour en Europe ou en Amérique du Nord est loin d’avoir faibli.
Il n’existe aucune trace d’un migrant ayant demandé l’asile au Rwanda.
